General Terms and Conditions (GTC) of dbtuning.ch / Delibas GmbH
1. Scope
1.1 These General Terms and Conditions (GTC) govern the business relationship between Delibas GmbH, operator of the online shop dbtuning.ch, (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Customer") for all orders and deliveries within Switzerland.
1.2 These Terms and Conditions apply exclusively to orders placed through the online shop dbtuning.ch. Any deviating or additional terms and conditions of the customer will not be recognized unless the seller has expressly agreed to them in writing.
1.3 By submitting an order, the customer agrees to these terms and conditions.
2. Conclusion of contract
2.1 The products and prices presented in the online shop represent a non-binding invitation to order.
2.2 By submitting an order, the customer makes a legally binding offer to purchase the selected products.
2.3 The contract is only concluded upon acceptance by the Seller. Acceptance occurs through written confirmation via email or through delivery of the ordered goods.
2.4 The Seller reserves the right to refuse orders without giving reasons, in particular in the following cases:
- Unavailability of the goods
- Incorrect pricing or product descriptions
- Suspicion of misuse of payment services
3. Prices and payment
3.1 All prices in the online shop dbtuning.ch are stated in Swiss francs (CHF).
3.2 The prices include statutory value added tax (VAT), unless otherwise stated (e.g. dealer prices excl. VAT).
3.3 The seller offers the following payment methods:
- Credit and debit cards
- Prepayment (bank transfer)
- Twint
- PayPal
3.4 Payment must be made in full before the order is processed and dispatched.
3.5 The goods remain the property of the seller until full payment has been made ( retention of title ).
4. Delivery and shipping
4.1 Shipping is only possible within Switzerland via DHL .
4.2 Shipping costs are borne by the customer and are displayed during the ordering process.
4.3 Delivery times depend on the product and will be communicated to the customer in the order confirmation. Delays caused by suppliers or external factors are beyond the seller's responsibility.
4.4 The Seller is not liable for damage or loss during transport. If the shipment arrives damaged, the Customer must immediately report this to the shipping company.
5. Return and cancellation
5.1 Returns are generally excluded.
5.2 Custom-made items and items specially ordered for the customer are excluded from return .
5.3 In exceptional cases, a return may be made after consultation with the seller. In this case, a Processing fee of 20% of the purchase price retained.
5.4 Cancellations are only possible before the goods are shipped. If the order has already been processed or shipped, cancellation is no longer possible.
6. Guarantee and warranty
6.1 Only the warranty of the respective manufacturer applies.
6.2 The seller assumes no guarantee or liability of its own for defects or damage to the products.
6.3 The customer is obliged to contact the respective manufacturer directly in the event of warranty claims.
6.4 A refund or exchange through the seller is excluded unless this has been explicitly agreed with the manufacturer.
7. Disclaimer
7.1 Assembly and installation:
- The seller assumes no liability for damages caused by the assembly or installation of the parts.
- It is strongly recommended that the installation be carried out by Specialist staff to be carried out.
7.2 Road approval and reports:
- The customer is responsible for the Use of the products in road traffic .
- The seller assumes no liability for products without an expert opinion or with unauthorized modifications.
- If an MFK inspection is required, the customer shall bear the associated costs.
7.3 Rims and body:
- The customer is responsible for checking whether rims are rubbing or touching the bodywork or other components.
- If adjustments are necessary, such as wheel spacers or bodywork, the customer bears the associated costs and risks.
8. Customer’s obligation to inspect
8.1 The customer is obliged to check the products received for completeness and defects immediately upon receipt.
8.2 The customer must check the reports and certificates provided for their accuracy and validity.
8.3 Complaints must be submitted within 5 working days after receipt of the goods in writing by email to the seller.
9. Retention of title
9.1 The goods remain the property of the seller until full payment has been made.
9.2 If the customer defaults on payment, the seller reserves the right to reclaim the goods.
10. Place of jurisdiction and applicable law
10.1 Only Swiss law .
10.2 The place of jurisdiction for all disputes is Muttenz, Switzerland .
10.3 Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
11. Data protection
11.1 The Seller processes personal data exclusively within the framework of applicable data protection laws.
11.2 Detailed information on the processing of personal data can be found in the Privacy Policy of the online shop.
12. Delivery times
12.1 Delivery times depend on the respective manufacturer. Delivery times are generally 5 to 14 working days after receipt of the order. If an item is no longer available, the customer will be informed immediately and has the choice between canceling the order or selecting an alternative item. Any price differences will either be refunded or must be paid.
12.2 Please note that actual delivery times may vary and depend on manufacturer availability. We will always endeavor to inform you promptly of any delays.
13. Changes to the Terms and Conditions
12.1 The Seller reserves the right to amend these Terms and Conditions at any time.
12.2 The version of the General Terms and Conditions valid at the time of the order shall apply.
